Payment:

An order is not binding upon Xiertekusa.com until it is accepted; Xiertekusa.com must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, wire transfer, or some other method prearranged with Xiertekusa.com. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. Invoices are due and payable in accordance with the terms listed on the front of this invoice. All goods are payable C.O.D. immediately upon receipt, unless otherwise arranged. An Interest charge of 19% per month will be added to past due accounts. A service charge of U.S. $35 will be assessed for each bounced check. Customers are responsible for paying any freight charge caused by refused shipment.

All orders sent by UPS, are insured against loss, theft and damage. Claims must be initiated with UPS. Xiertekusa.com will not be responsible for any delivery delays by UPS. In the event of any delays or lost packages, Xiertekusa.com will assist customers in tracking packages shipped by UPS. Additional service fees may be applied to orders shipped via UPS with incorrect/incomplete addresses thus resulting in additional routing charges by UPS

Back Orders: Any unavailable items are automatically placed on back order. Back order items will be immediately shipped when the product arrives. We calculate shipping charges as if your line items all shipped simultaneously. There is no additional shipping fee for back ordered shipments. We will update your order status via email.

Credit and DOA: All sales are final. Absolutely no refund after customer received order in correct shipment. Only store credit will be issued. Xiertekusa.com will only pay the freight for wrong item receiver. Credit and Dead on Arrival must be claimed within 2 day after receiving the merchandise, and Xiertekusa.com will not pay any freight or handling fees cause by or result in these matters. Absolutely no credit for CPUs, memory, and open software.

Change/Cancel Orders: You may change or cancel your order by phone or email, if the order has not posted to the shipping process. Most orders post 30 minutes after order confirmation. If the order has commenced the shipping process yet has not yet departed the warehouse, you need to call during business hours to change or cancel your order. Please always have your order number ready.

Refused orders: Refused shipments are subject to minimum 15% to maximum 35% cancellation fee plus Shipping and Handling charges.

Limited Warranty: We warranty its products to be free form defects in material and under normal use and service. CPU and Memory come with 90 days limited warranty. Beside CPU and Memory, all the product come with one year warranty. Xiertekusa.com will not responsible for consequential damage to the system or its components or other merchandise cause by either internal or external equipment, shorted connections or components not installed or obtained from us. We shall not be liable for damage to painted surfaces or keyboard keys due to physical abuse, or excessive use or liquids, or chemicals spilled upon or inside the system, including oxidation or corrosion to components caused by exposure to salt air. This limited warranty is contingent upon proper use of the product and it dose not cover products which have been modified or which have been subjected to unusual physical or electrical stresses. The limited warranty also does not cover any losses or damages that may occur as result of: 1) shipping or improper installation or maintenance, 2) misuse, neglect or improper environment, and 3) excessive or inadequate electrical power surges, or other irregularities.

Return Merchandise Authorization (RMA): To obtain service for your return merchandise, a RMA number must be obtained first from our RMA department. Please follow the RMA procedures and policies below in order to speed up your RMA processing.

1. To receive a RMA number, you must call or fill out our RMA from completely and fax it together with the original invoice (Proof of Purchase) to our RMA Dept. You must provide description of return products, serial number, and reason for return in order for us to issue a RMA number. A RMA number will not be issued if the original invoice is not provided.
2. All returned items must he tested by the customer prior to being shipped back to us to ensure the item is defective. 
3. You must obtain a RMA number (or a credit number) for all returns for credit or each order, and we must receive the returned merchandise within 10 days after the RMA number is issued. Credit of all returns will be given according to the market price at our cost, and a 15% to 25% restocking charge shall apply to all returns for credit if the merchandise had used or taken out from the original package.
4. A RMA number is valid for 5 working days only. Returns must be shipped freight pre-paid by the customer. Please write the RMA number clearly on the outside of the box, the mailing label, or package list when ship the returns back to us. Otherwise, your returns will be refused. Freight collect or C.O.D. returns will be refused. Open box package will also be refused.
5. Dead on Arrival items for immediately exchange must be claimed within 1 day after receiving the merchandise. Cross shipment will be issued only if merchandise is brought in for exchange. Absolutely no cross-shipment through UPS, FedEx, or any mail.
6. Products return for RMA, exchange or credit must be received by us in like new condition and must be in their original packaging. Included with the returned product, there must be all necessary manuals, cables, drivers, accessories, original manufacture box, etc. Otherwise, they will be replacing as the way we received or a 25% restocking fee may apply.
7. If we do not have the product in stock for replacement at the time we received the detective merchandise, we reserve the right to keep it up to 45 days for repair or exchange from the original manufacture. No credit will be given within this 30 days period. If the merchandise is a discontinued or we cannot replace it after 30 days, credit will be issued according to the original invoice price.
8. Minimum $5 Charge will apply on all the returned order + 15% restocking fee.

Attorney Fee and Applicable Law: In the event of an expense is incurred or an attorney is employed to compel payment of the unpaid invoice or to declare ay action, the buyer agree to pay us such expenses and attorney fees. Moreover, In the event of the jurisdiction over any dispute between the buyer and us, all California Business Laws will apply and we reserve the right to choose any of the State Federal courts located in the State of California. Governing Law and Jurisdiction: Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Xiertekusa.com and Customer shall be governed by the laws of the State of California, without regard to its conflicts of law rules. Specifically, the United Nations Convention on the International Sale of Goods shall not govern the validity, interpretation, and performance of this agreement Xiertekusa.com and Customer consent to the exclusive jurisdiction and venue of the State Courts of the State of California, Los Angeles County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Xiertekusa.Com that is more than one year after the date of the applicable invoice. Sever ability: If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable California law.

Exports by Buyer: Buyer shall be responsible for obtaining an export license from the U.S. Department of commerce for all products sold to it by us, and what is shipped outside of the United States.

Note: We reserve the right to make changes of the terms and conditions at any time. Additional terms and conditions or notes listed on the front of this invoice will be applied. The terms and conditions listed at our web site will also be applied.

Waiver: The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement: These terms and conditions, together with Xiertekusa.com's invoice respecting the products ordered by Customer, are the complete and exclusive agreement between Xiertekusa.com and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Xiertekusa.com  Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Sales Tax, Payment & Term.

People who live in the state of California must pay sales tax. Please inquire about bulk orders. We ship anywhere but shipping charges are a couple dollars more if you live outside the state of California. There's no sales tax for interstate or out of state customer. We also deal, ship and accept foreign customer's order.
